1. Who we are
uvatuga.com is operated by Your Company, Lda., NIPC 000000000, Rua Exemplo, 1, 0000-000 Lisboa, Portugal (“Uvatuga”, “we”). Contact: wine@uvatuga.com.
2. Scope
These terms apply to distance sales to consumers through this website, under Portuguese Decree-Law 24/2014 and other applicable Portuguese and EU consumer law. By placing an order you confirm you have read and accept them.
3. Minimum age
The sale of alcoholic beverages to anyone under 18 is prohibited (Decree-Law 106/2015). By ordering you declare that you are 18 or older. We may ask for proof of age and may refuse or cancel an order where there is doubt.
4. Products and descriptions
We sell individual bottles, many of them old vintages. Each bottle is photographed and described by us, including fill level, label and capsule condition, and known provenance. Photos show the actual bottle for sale.
Old wines are natural products that evolve in bottle; cork, colour and sediment vary from bottle to bottle. These features of ageing are not, in themselves, a lack of conformity, provided the bottle matches its published description. Your statutory rights are not affected.
5. Prices
Prices are in euros and include Portuguese VAT at the applicable rate. Shipping costs are shown in the cart before payment. If there is an obvious pricing error we will tell you, and you may confirm or cancel the order with a full refund.
6. Ordering and payment
The contract is formed when payment is confirmed. Payment is processed by Stripe (cards, MB WAY, Apple Pay, Google Pay and other available methods); we never see your card details. We email you a confirmation; the invoice is issued in the name given on the order — if you need a VAT/tax number on it, reply to the confirmation email.
Bottles are held for up to 30 minutes while you complete payment. If a bottle becomes unavailable after payment (an exceptional case) we refund you in full immediately.
7. Shipping and delivery
We only ship to the countries listed on the Shipping & returns page. Orders are prepared within 2–4 working days; the maximum delivery time is 30 days unless agreed otherwise. Risk of loss or damage passes to you on delivery.
8. Right of withdrawal
You have the right to withdraw from this contract within 14 days of the day you receive the goods, without giving any reason. To exercise it, send us a clear statement (for example an email to wine@uvatuga.com); you may use the EU model withdrawal form but it is not required.
You must send the bottles back without undue delay and at the latest 14 days after telling us. You bear the direct cost of returning them. Bottles must be unopened and in the condition received; you are liable for any loss of value resulting from handling beyond what is needed to establish the nature and characteristics of the goods.
We refund all payments received, including the original delivery cost (at the least expensive standard rate), within 14 days of your withdrawal notice, using the same payment method. We may withhold the refund until we have received the bottles back.
9. Legal guarantee
Goods are covered by the statutory guarantee of conformity (Portuguese Decree-Law 84/2021, implementing Directive (EU) 2019/771). If a bottle does not match its description or arrives damaged, contact us and we will put it right by replacement (where an equivalent bottle exists), price reduction or refund.
10. Complaints and dispute resolution
You can file a complaint in the Portuguese electronic complaints book or write to wine@uvatuga.com. For consumer disputes you may contact an alternative dispute resolution body: CNIACC – Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (www.cniacc.pt).
11. Governing law
Portuguese law applies, without prejudice to the mandatory consumer-protection rules of your country of habitual residence.
